By booking any services listed at https://www.emschwarze.com/ or performed by Emily Schwarze, you acknowledge and agree to the following terms and conditions without any exceptions.

The following Terms & Conditions form is part of your agreement with Emily Schwarze, (Sole Trader at emschwarze.com and Emily Schwarze Massage Therapy), and your booking of any service, will constitute acceptance of these Terms and Conditions when you become a client. For the purpose of these Terms & Conditions, Emily Schwarze will constitute “The Therapist” and you “The Client”.
This agreement is effective immediately upon booking or discussing any services performed at https://www.emschwarze.com/.

Participation

1. You agree to take full responsibility for your success and the results you receive with the services provided by doing everything you can to maximize your results including following the exact guidance provided to you.
2. You agree to follow all guidance exactly as stated by The Therapist. If the state of The Client changes in any way by new disease state, medicine introduced, dietary change, concurrent therapies introduced, exercise programs,or any other activities, at the same time, performed or introduced by The Client, that can influence treatment, The Client is obliged to immediately inform The Therapist so she can take the necessary actions for the best of The Client.
3. You also understand that the services provided are not a “silver bullet,” or an “overnight,” process and that patience, commitment and persistence is required to achieve desired success.

Guarantee
The Therapist commits to offer:

1. Excellent customer care, treating you (The Client) with dignity and respect.
2. To provide a safe, clean, private and confidential setting to receive your treatment
3. To offer the most efficient, safe, effective, highest quality service to suit your individual needs.
4. To abide by the Hippocratic Oath, “First do no harm.”

In order to ensure that The Therapist is able to offer the best service for The Client, the following rules are in place:

1. All services are by appointment only. Walk-ins are not permitted as a courtesy to clients who have already booked and committed to the sessions.
2. The Therapist is not liable if you ignore her recommendation, at any time, to seek medical advice.
3. The Therapist will not knowingly undertake any treatments on clients who are under the influence of drugs or alcohol. This fact must be disclosed to The Therapist to avoid harm to The Client. Please acquaint yourself on Contraindications to treatment under FAQ’s.
4. It is imperative that both our boundaries are honored during our session together. Any inappropriate behavior on The Client’s side will result in The Therapist terminating the session immediately and without refund.
5. The Therapist only provides legitimate and professional services. We do not offer any services other than those stated.
6. Underwear and cleanliness is required for all clients unless stated.
7. During massage treatments, towels are used to cover the parts of the body not being treated. This is to protect the dignity of the client and for purposes of comfort and hygiene.
8. If you feel uncomfortable with any aspect of the session or wish your therapist to stop at any time, you must make this clear by expressing this to The Therapist.
9. You shall not now or at any time in the future bring any legal action against The Therapist and agree that this waiver is binding on you, your heirs, your spouse, your children, your legal representatives, your successors and your assignees. You understand that the information contained in the program material is strictly for educational purposes. Therefore, if you wish to apply (or not apply) ideas contained in this material, you are taking full responsibility for your actions.
10. Please arrive at least a few minutes early.
11. Please ensure your mobile phone is switched off or in silent mode and that there are no distractions of any kind that can disrupt the session.
12. In the unlikely event that The Therapist has an interruption, patience on the part of The Client is appreciated.

Home Visits

1. The Therapist is not liable for loss or damage to your property whilst attending home visits.
2. Sessions start at the agreed upon time and any delays caused by The Client’s side will be taken out of the time reserved by The Therapist for the respective session without exceptions.
3. Please ensure your mobile phone is switched off or in silent mode and that there are no distractions of any kind that can interrupt the session. The time reserved for the client starts and ends as per the initial agreed upon consultation.

Remote Therapies etiquette

1. Client must arrive at least a few minutes early.
2. Client is obliged to ensure your mobile phone is switched off or in silent mode.
3. Your remote treatment session will last for the duration agreed at the time of booking.

Communications

1. All questions or support requests must be sent to my WhatsApp +529841767510 and I will get back to you within 2 business days. Should you require urgent, immediate assistance you can message me and let me know it is urgent.
2. I cannot guarantee any responses to phone calls or to questions via email.
3. Support will not be available on Sunday or Public Holidays or in the unlikely situation where The Therapist has an emergency..

Payment

1. Payment for single treatments must be made in full at the end of each visit.
2. Payment for group treatments must be made 50% in advance. Once the payment is made the booking takes effect.
3. Payment for packages must be paid in full at the end of the first session.
4. Payment by PayPal or Wise must be paid in full at the end of the first visit and no later than that same day of the session.
5. Preferred forms of payment are: cash (USD or MXN equivalent), Wise, PayPal (emilyschwarzemassage@gmail.com), or Debit/Credit Card. A 5% processing fee will be charged for all PayPal and Debit/Credit Card transactions.

Cancellation Policy

1. Our policy is 50% of the fee if canceled within 24 hrs as is written in your confirmation email. You will be charged in $USD.
2. We do not offer refunds for modifications of any kind, including cancelation, for group treatments.
3. Payments are made through PayPal https://www.paypal.me/emschwarze.
4. Refunds are not given for no-shows or scheduling requested less than 24hrs prior to the agreed consultation. In such cases, a new appointment must be scheduled and full payment is requested.

Lateness Policy

1. If the client is late, their treatment cannot be extended and will end at the appointed time.
2. If the Therapist is late additional time will be added to the treatment or to subsequent treatments.

Refunds

1. I do not provide any refunds for payments under any circumstances.
2. In addition, you hereby ratify your understanding that all services are non-refundable and non transferable you waive any rights to charge-back your purchase with your credit card processor.
3. No refunds are given if the client engages in activities of any kind which might negatively influence the course of session or outcome of the program or protocol. In such cases, the session is terminated and The Therapist reserves the right to not offer the possibility of another session or further guidance.

Suspension of Services

1. I am committed to providing all clients with a positive experience throughout the sessions, programs or protocols.
2. Thus, i may, at my sole discretion, limit, suspend, or terminate your participation in any of its programs, live, recorded, social media-based or digital without refund or forgiveness of remaining payments if you become disruptive or difficult to work with; or you fail to follow the program guidelines; or, you impair the participation of other participants in our program(s).

Privacy & Confidentiality

1. I abide by a strict code of ethics and laws whereby all medical information provided and anything that happens during a session is strictly confidential and stays within the treatment room.
2. All your medical information shared remains confidential, unless I have explicitly asked for your permission to share pertinent information with another health professional in your best interest.
3. Any information given by the Therapist to The Client is especially tailored for that respective client, in that respective time frame, based on the information given by The Client. By sharing this information with a third party, the client risks not only copyright legal action but also the risk of endangering others’ wellbeing as the said information might not apply for the other party other than the client for which the information has been carefully designed.
4. All content and materials available on emschwarze.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of emschwarze.com, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by emschwarze.com.
5. I must insist that you also respect the same rights of my programs and protocols and of fellow program participants.

Thus, you agree:

1. not to infringe on any Program participants or my copyright, patent, trademark, trade secrets, or other intellectual property rights;
2. that any Confidential Information shared by Program participants;
3. not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;
4. that all materials and information provided to you by the therapist are its confidential and proprietary intellectual property belonging solely and exclusively to me, and may only be used by you as authorized by me.
5. the reproduction, distribution and sale of these materials by anyone but myself is strictly prohibited;
6. that if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph myself and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.
7. While you are free to discuss your individual results from our programs and training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.
8. You further agree that your participation is subject to our Privacy Policy and Terms of Use.

Medical Information

1. You understand and agree that it is your responsibility to inform the Therapist of any conditions or changes to your health, now and on-going, which may affect, and, or contraindicate you to having a treatment.
2. If your Therapist requires further medical information from a practitioner, you must provide such details.
3. Your Therapist cannot be held liable in any way for undeclared or unknown medical conditions.
4. You understand that this therapy is not a substitute for medical advice and/or treatment.
5. The Therapist is not liable if you ignore her recommendation, at any time, to seek further medical advice.
6. If you share information that indicates that you are seriously planning to harm yourself or another person, or if you share information about a minor that is being physically harmed, The Therapist may disclose that information directly to the police or other appropriate authorities with or without your consent.

Use of Testimonials

1. Testimonials are individual experiences, reflecting real life experiences of those who have used our products and/or services in some way. They are individual results and results do vary. We do not claim that they are typical results. The testimonials are not necessarily representative of all of those who will use our services.
2. Emily Schwarze Massage Therapy is not responsible for any of the opinions or comments posted on social media. 2. The Therapist is not responsible in any way for any unwanted outcomes from any service offered, as The Client is considered a responsible intelligent adult, capable to discern and inform The Therapist at any given moment about any changes experienced.
3. The Therapist and/or Emily Schwarze (the “Company”) does not accept liability (except as set out below) for any errors and omissions and reserves the right to change information, specifications and descriptions of listed packages and services. The Therapist and/or the Company will use reasonable effort to correct errors and omissions as quickly as practicably possible after being notified of them.
4. The Therapist will only be liable for direct loss up to a maximum total of the price of the treatments purchased by the Client in respect of any claim.

The Therapist shall not be liable for any loss or injury attributable to:

1. the Client’s fault
2. a third party unconnected with the provision of services provided by your Therapist; or events which your Therapist, nor her suppliers or agents could have foreseen or forestalled, even if they had taken reasonable care.

Website Terms & Conditions
